The CAA, passed by the Parliament on December 11, 2019, and notified on December 12 of the same year, aims to protect individuals who have sought refuge in India due to religious persecution. It offers them a shield against illegal migration proceedings. Let’s delve into its key provisions:
- Inclusion of Persecuted Minorities: The CAA provides a path to Indian citizenship for Hindus, Sikhs, Christians, Buddhists, Jains, and Parsis who migrated from neighbouring Muslim-majority countries – Pakistan, Bangladesh, and Afghanistan – before December 31, 2014. These communities faced religious persecution in their countries of origin.
- Accelerated Citizenship: Under the CAA, migrants who entered India till December 31, 2014, and suffered “religious persecution or fear of religious persecution” are eligible for accelerated citizenship. The residence requirement for naturalization has been relaxed from twelve years to just six.
- Fulfilling a Promise: The implementation of the CAA was promised by the ruling Bharatiya Janata Party (BJP) in its previous election manifesto. Now, with the rules notified, the commitment to minorities is being fulfilled.
Strengthening Indian Democracy
The CAA plays a pivotal role in strengthening our democratic fabric:
